1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and JobHub BW ("Company," "we," "us," or "our") concerning your access to and use of the jobhub.co.bw website and any related services (collectively, the "Platform"). By accessing or using the Platform, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Platform.

2. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws and regulations
• All information you provide is accurate, current, and complete

3. User Accounts

3.1 Account Creation

To access certain features of the Platform, you must create an account. When creating an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Types

The Platform supports five user roles:

• Job Seekers: Individuals seeking employment opportunities
• Employers: Organizations seeking to hire candidates (subject to approval)
• Service Providers: Individuals offering services in the piece-jobs marketplace
• Piece Job Posters: Users posting short-term work opportunities
• Administrators: Platform administrators with management capabilities

3.3 Account Security

You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

4. User Conduct

You agree not to:

• Provide false, inaccurate, or misleading information
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Upload viruses or other malicious code
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Interfere with or disrupt the Platform or servers or networks connected to the Platform
• Use the Platform for any commercial purpose without our prior written consent
• Scrape, harvest, or collect information about other users without their consent

5. Job Seeker Obligations

If you are a job seeker, you agree to:

• Provide accurate and truthful information in your profile, CV, and applications
• Keep your profile and documents up to date
• Not submit false or fraudulent applications
• Respect the privacy and confidentiality of employer information
• Comply with all applicable employment laws and regulations

6. Employer Obligations

If you are an employer, you agree to:

• Provide accurate information about your organization during registration
• Post only legitimate job opportunities
• Comply with all applicable employment and anti-discrimination laws
• Respect candidate privacy and use candidate information only for recruitment purposes
• Not share, sell, or distribute candidate information to third parties without consent
• Maintain the confidentiality of candidate data accessed through the Platform
• Await approval from administrators before accessing the candidate database

7. Service Provider Obligations

If you are a service provider, you agree to:

• Provide accurate information about your services and qualifications
• Upload only authentic portfolio items that represent your work
• Deliver services professionally and as described
• Comply with all applicable business and licensing regulations
• Respect client confidentiality and privacy

8. Content Ownership and License

8.1 Your Content

You retain ownership of all content you submit to the Platform, including your profile information, CV, documents, and portfolio items ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display Your Content for the purpose of operating and improving the Platform.

8.2 Platform Content

The Platform and its original content (excluding Your Content), features, and functionality are owned by JobHub BW and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Content Moderation

We reserve the right to:

• Review, moderate, and approve or reject user-generated content
• Remove any content that violates these Terms or is otherwise objectionable
• Suspend or terminate accounts that violate these Terms
• Approve or reject employer registrations
• Moderate service provider profiles and piece-job postings

We are not obligated to monitor content but may do so at our discretion.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

11. Fees and Payments

Currently, the Platform is free to use for all users. We reserve the right to introduce fees for certain features or services in the future. If we introduce fees, we will provide advance notice and obtain your consent before charging you.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Platform will be uninterrupted, secure, or error-free
• The results obtained from using the Platform will be accurate or reliable
• The quality of any products, services, information, or other material obtained through the Platform will meet your expectations
• Any errors in the Platform will be corrected

We do not verify the accuracy of information provided by users and are not responsible for the conduct of users or the quality of services provided through the Platform.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBHUB BW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE PLATFORM.

14. Indemnification

You agree to indemnify, defend, and hold harmless JobHub BW, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another party.

15. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Botswana, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Botswana.

17. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Platform prior to the changes taking effect. Your continued use of the Platform after the changes take effect constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be deemed modified to the extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JobHub BW regarding your use of the Platform and supersede all prior agreements and understandings.
